Pre-sale terms – online course "First aid for dogs and cats"

These Pre-sale Terms set out the rules for the pre-sale of the online course "First aid for dogs and cats" and of the course-plus-first-aid-kit bundle on opatulo.pl. They supplement the opatulo.pl Terms and Conditions, which apply to all matters not covered here. In case of any discrepancy between language versions, the Polish version prevails. Effective date: 05.08.2026.

1. General provisions and Seller details

The Seller and organiser of the pre-sale is:

(the "Seller" or "Opatulo").

These Pre-sale Terms apply to orders for the Course and the Bundle placed from the moment purchasing is made available on the Website. Matters not covered here are governed by the opatulo.pl Terms and Conditions; capitalised terms not defined below have the meaning given to them there.

These Terms are made available free of charge and continuously on the Website in a way that allows them to be obtained, reproduced and saved at any time. The Buyer receives confirmation of the contract together with these Terms (or a link to them) on a durable medium – at the email address provided.

3. Subject of the Pre-sale

The subject of the Pre-sale is:

At the time of the Pre-sale the Course is in production – by buying in the Pre-sale, the Buyer purchases digital content that will be delivered at a later date: on the day of the Premiere (section 6). The scope of the Course (lesson list) and the Additional Materials are described on the Course page on the Website. Minor changes to the lesson layout that do not change the substantive scope or overall length of the Course do not constitute a change to the contract.

The Course is educational and informational. It does not replace veterinary advice, diagnosis or treatment. If your pet's health or life is at risk, contact a veterinarian immediately.

4. Prices and payments

Prices are given in Polish zloty (PLN) and are gross prices. The Course price involves no additional costs. For the Bundle, the Kit delivery cost – if any – is clearly indicated before the order is placed.

Whenever price reductions are announced, the Seller displays, next to the reduced price, the lowest price of the given product from the 30 days preceding the reduction, in accordance with applicable law. The pre-sale price is the market-introduction price; the regular price shown next to it is the price planned after the Premiere.

Available payment methods are indicated during the ordering process and may include: fast online payments and BLIK (via an external payment operator) and a traditional bank transfer to the Seller's account. Settlements are carried out in accordance with the terms of the relevant payment operator; the Seller does not store payment card data.

If payment is not made within the period indicated for the given payment method, the order may be cancelled, of which the Buyer will be informed.

For each order the Seller issues a proof of sale (a receipt or – on request or where required by law – an invoice).

5. Placing an order and concluding the contract

Information about the Course and the Bundle on the Website constitutes an invitation to conclude a contract, not an offer within the meaning of the Polish Civil Code.

An order is placed by selecting the Course or the Bundle, providing the data necessary for fulfilment (including an email address and – for the Bundle – a delivery address), choosing a payment method and confirming the order with a button labelled "Order and pay" (or an equivalent label clearly indicating a payment obligation).

The contract is concluded when the Seller confirms acceptance of the order by email. The confirmation includes the order details, the planned Premiere date and the information required by law, including notice of the right of withdrawal.

The contract for the Course is a contract for the supply of digital content at a later date (on the day of the Premiere). The contract for the Bundle additionally covers the sale of the Kit.

6. Premiere and delivery

Course: no later than on the day of the Premiere, the Buyer will receive access to the Course on the Course platform (a link and access details) at the email address provided. The Course is deemed delivered when access is made available.

Kit (in the Bundle): shipped by courier or another operator indicated on the Website, to the address given in the order, within the period indicated in the Bundle description, but no later than 14 days after the Premiere.

Change of the Premiere date: if the Premiere date changes, the Seller will promptly inform Buyers by email, indicating the new date. If the delay relative to the date indicated in the order confirmation exceeds 30 days, the Buyer may withdraw from the contract and the Seller will refund all payments received within 14 days. This right does not limit the statutory rights of Consumers and PNPK, including the right to call for delivery of the digital content and to withdraw from the contract if it is not delivered.

7. Access to the Course and licence

Access to the Course is granted for an indefinite period ("lifetime access") – for as long as the Seller maintains the Course platform, and no less than 36 months from the Premiere. If maintaining the Course platform becomes impossible after that period, the Seller will inform Buyers in advance and enable them to download the Additional Materials and – where technically possible – the video lessons.

Using the Course requires: a device with Internet access, an up-to-date web browser and an active email account. The Course can also be watched on mobile devices.

The Course and the Additional Materials are intended solely for the Buyer's own use. Sharing access details with third parties, copying, distributing, reselling or publicly presenting the Course is not permitted. The economic copyrights to the Course belong to the Seller.

8. Pre-sale guarantee and right of withdrawal

8.1. Pre-sale guarantee (contractual)

Independently of statutory rights, the Buyer may cancel the order at any time up to the day of the Premiere – without giving a reason. An email to kontakt@opatulo.pl is enough. The Seller will refund all payments received within 14 days, using the same payment method the order was paid with (unless the Buyer agrees to a different one).

8.2. Statutory right of withdrawal (Consumer and PNPK)

A Consumer or PNPK may withdraw from a distance contract within 14 days without giving a reason:

Sending the declaration (e.g. by email) before the deadline is sufficient to meet it. The statutory model withdrawal form may be used, but is not obligatory. The rules on refunds and the cost of returning the Kit are set out in the Terms and Conditions (section 8).

8.3. Loss of the right of withdrawal from the Course after the Premiere

The right of withdrawal from a contract for the supply of digital content does not apply if the Seller has begun performance (made the Course available) with the prior, express consent of the Consumer or PNPK, who acknowledged that they would thereby lose the right of withdrawal, and the Seller has provided confirmation of the contract on a durable medium. The relevant consent is collected during the ordering process or before the Course is made available.

8.4. Returning the Kit – hygiene considerations

If the Kit or its components are delivered in sealed packaging which cannot be returned after opening for health-protection or hygiene reasons (e.g. dressing materials), the right of withdrawal does not apply to components whose packaging was opened after delivery.

9. Complaints

The Seller is obliged to deliver the Course and the Kit in conformity with the contract. In the event of non-conformity, Consumers and PNPK have the rights described in consumer-protection law and in section 9 of the Terms and Conditions.

Complaints can be submitted to kontakt@opatulo.pl or by post to the Seller's address. The Seller responds to a Consumer's complaint within 14 days of receiving it; no response within that period means the complaint is accepted.

Consumers may use out-of-court complaint and redress procedures, including the ODR platform (ec.europa.eu/consumers/odr) – see section 13 of the Terms and Conditions.

10. Personal data

The Seller is the controller of Buyers' personal data. The rules on processing data in connection with orders, payments and delivery – including purposes, legal bases, data recipients and your rights – are described in the Privacy policy.

11. Final provisions

Matters not covered here are governed by the opatulo.pl Terms and Conditions and Polish law, in particular the Civil Code and the Consumer Rights Act. These Pre-sale Terms are not intended to exclude or limit the rights of Consumers and PNPK under mandatory provisions of law; in the event of any conflict, those provisions take precedence.

A change to these Pre-sale Terms does not affect contracts concluded before the change takes effect – orders placed earlier are fulfilled under the previous rules.
